The Industry Portal does not guarantee the accuracy of information provided by external sources and accepts no responsibility or liability for any consequences arising from the use of such data.

Though Fusion for Energy uses the best technical standards to control its site, material on this website may inadvertently include technical inaccuracies or other errors. We should be grateful if users could notify us of any errors or inaccuracies they may find. Please note that users browse and use the website at their own risk. Fusion for Energy uses IP addresses in order to carry out statistics, however, as IP addresses and personal identification are not linked to each other users remains anonymous.

7. Transaction Time-Stamps

The recorded time of transactions in the Industry Portal are synchronised directly with four geographically dispersed Stratum 1 devices which are attached to atomic (caesium, rubidium) or GPS clocks.

- ROA: hora.roa.es, the official time-source of Spain and legal time stamping authority;

- IRIS: hora.rediris.es;

- University of Valencia: gong.ci.uv.es;

- Universidad Autónoma de Madrid: hora.uam.es.

The final timestamp is an average of three time services while discarding the most divergent time source each time.
The times reported on the Industry Portal are in Central European Time / Barcelona Time.


8. Copyright

a. Definition

Material in this Legal Notice includes data, text, software and multimedia, such as images and sound that might be made available or publicized through the 'Fusion for Energy' web site.
The platform, its general structure, as well as the logos, the text, the pictures, or any other element constituting this portal are owned by Fusion for Energy.

b. Authorization

Reproduction of material published on this web site is authorized, provided that the source is acknowledged, unless it is stated otherwise. Where prior permission must be obtained for the reproduction or use of material published on this web site, the above mentioned permission shall be cancelled and restrictions shall be imposed as appropriate through a legal notice published on that specific material. The contents of the Fusion for Energy Industry Portal are intended for the personal and non-commercial use of its users. 9. Data Protection

Fusion for Energy is committed to user privacy and complies with the Regulation (EU) 2018/1725 on the protection of individuals with regard to the processing of personal data by the Community institutions, bodies, offices and agencies and on the free movement of such data. In accordance with Articles 14 and 15 of the Regulation, Fusion for Energy provides users with the following information:

Personal data (as well as other information gathered by Fusion for Energy) will be used for:

• Management of the tendering procedures launched by Fusion for Energy, and
• Reporting and monitoring that may be carried out in relation with F4E activities, such reporting and monitoring include but is not limited to statistics and assessment of the F4E suppliers’ performance.
• Maintaining accurate data related to companies interested in F4E’s business activities
• Facilitation potential partnerships between companies

c. Lawfulness of the processing
By creating an account in the portal, user consents to processing of his/her personal data on conditions set out in this terms and conditions, which constitutes a ground for lawfulness of data processing under Article 5(d) of the Regulation (EU) 2018/1725.

With regard to the personal data included in the information published in the portal by registered companies, notably personal data of companies’ contact persons, it is the company responsibility to ensure that such data are provided lawfully, upon the data subject’s informed consent.

d. Data Concerned

(i) Personal data

Personal data of users visiting the portal, which can include the following:
• Individuals representative of a company;
• Natural persons acting on their behalf;
• F4E Industry Liaison Officers (ILOs) nominated by the relevant Members States.

(ii) Other data

All the other data provided by the portal users which does not constitute personal data (mainly data concerning companies as legal persons)

e. Categories of data

(i) Personal data

Identification details of registered users with the following mandatory fields of information: first and last name, professional e-mail address, professional phone number, Country of registration of the company.

(ii) Other data

Among others, companies’ contact persons provide the following information: company name, VAT Number, country of origin of the company, main competences of the company (robotics, welding, engineering, CAD etc.).

f. Recipients of the data processed

• F4E Market Analysis officers
• F4E ICT officers (access to the application for technical reasons only)
• Other companies registered in the portal
• Industry Liaison Officers (from EU countries)

Also, only if appropriate and necessary for monitoring or inspection tasks, access to personal data of Industry Portal users may be given to: • F4E Director
• Head of Admin.
• DPO
• Anti-Fraud & Ethics Officer
• Head or responsible officer of LSU, IAC, IDOC

g. Date when processing starts

Date when data are registered / upload by a user to an F4E server via the Industry Portal.

h. Time limits for storage

Personal data of persons with an account in the F4E Industry Portal and personal data of companies’ contact persons are stored as long as registered user wishes so, And as long as Fusion for Energy operates in its mandate to deliver the EU contribution to the ITER Project.

i. Right of access and rectification

Users have the right of access to their personal data and the right to rectify any such data that is inaccurate or incomplete through contacting the Data Controller. The person with an account in the portal can himself/herself access the personal data published in the portal, rectify or erase them when s/he is logged in.

Should user have any queries concerning processing of personal data, s/he may address them in writing to the Data Controller at the following address: Commercial-Department-Controller@f4e.europa.eu or to the Data Protection Officer at: DataProtectionOfficer@f4e.europa.eu. Data subjects have also the right of recourse at any time to the European Data Protection Supervisor (EDPS): edps@edps.europa.eu.

j. How does F4E protect and safeguard your information?

F4E stores data, including personal data, in secure computers which can be accessed only by authorized persons and from F4E internal sites, except for the data made available as provided for in section 9. f) above.

When a user logs in, the password is always encrypted on the network and is decrypted for checking against the stored password by the authentication service, not by the individual site. All passwords (including previous passwords mentioned above) are stored in a form that permits them to be checked against a supplied value, but their actual value cannot be derived from the stored value.

The details of a user account are available only to the user and the service administrators.

If you registered yourself directly, you should be aware that anyone with access to read your e-mail may be able to use the account you create and acquire the identity it represents. You are responsible for assessing the risk that this presents to you personally.

Similarly, certain users are allowed to reset their password using e-mail. They should bear in mind that anyone else with access to their e-mail (because of automatic forwarding, delegation or other reasons) will be able to reset the password.


10. National and EU Law

This disclaimer is not intended to limit the liability of 'Fusion for Energy' in contravention of any requirements laid down in applicable national law or to exclude its liability for matters which may not be excluded under that law.

In accordance with Council decision of 27 March 2007 establishing the European Joint Undertaking For Iter And The Development Of Fusion Energy and conferring advantages upon it (OJ Reference: I 90/58 Publication date: 30.03.07), any dispute resulting from the use of this Industry portal which cannot be settled amicably shall be brought before the Court of Justice of the European Union in Luxembourg.


11. Technical requirements

a. Platform access

Access to the Fusion for Energy industry portal e-tendering system is reserved to users with access to the Internet.

It is recommended use the following versions of Microsoft Internet Explorer for entire functionality.

- Windows Internet Explorer 7.x (32-bit)

- Windows Internet Explorer 8.x (32-bit) (includes running in compatibility mode)

- Windows Internet Explorer 9.x (32-bit and 64-bit) (includes running in compatibility mode)

With other browsers, full functionality cannot be guaranteed.

b. Bandwidth and Internet access
The Fusion for Energy industry portal uses a symmetrical-bandwidth Internet access. Effectively, the bandwidth which defines the effective download speed of the tender documents or the responses, is the one of the user’s workstation. Users must therefore ensure that their bandwidth is consistent with the size of the files they wish to download or upload.


12. FUNCTIONS AVAILABLE TO SUPPLIERS IN ANONYMOUS MODE

Access modes to the platform
The suppliers access the Fusion for Energy’s industry Portal via the Internet. The solution is accessible using a web browser.
Two access types can be used to reach Fusion for Energy’s Industry Portal:
• Anonymous sccess: the anonymous mode enables users to search for a tender and download the corresponding tender documents,
• Registered access: this level of authenticated connection enables users to directly access the tender document download, modify their personal profiles (automated search and alert criteria).

b. Searching for and downloading a tender document as an anonymous supplier
Once the tenders are published, users can access them
• Through a specific search, which can be performed by a registered user on the platform or by an anonymous one.
• After having received an alert by email. Alerts can be set-up by users, based on keywords

The search options are the following:
• Multiple keyword search: different keywords separated by blanks (example:“construction engineering”)
• Sentence search: regular expressions placed between double quotes (example: "IT master plan")
• Truncated search: part of a keyword followed by an asterisk (example: “demat*”for dematerialization, dematerialized, etc.)

A Supplier – previously registered on the platform or not – can view the list of the current calls for tenders (published and not closed), and make targeted searches using category, date, keywords, etc.

c. Supplier registration

Suppliers using the Fusion for Energy industry portal regularly may wish to enhance their experience by registering on the site. To that end, they must create an account on the platform.

A supplier that is not registered in the F4E Supplier database can still participate to a procurement or grant procedure. A supplier that is registered in the F4E Supplier database is not automatically eligible for a grant or procurement procedure.
